EXPERIENCE TERMS AND CONDITIONS
These Terms and Conditions contain important information about participating in an al Qadr Experience (hereafter referred to as “the Experience”), as organized by al Qadr, represented by Isamiddinova und Marouche GbR (hereafter referred to as "the Organizers"). By joining us and using our Services as a Participant (hereafter referred to as “Participant”) you are agreeing to these Terms and Conditions as a legally binding contract (hereafter referred to as “the Contract”).
We kindly ask that you read this carefully, before booking the Experience, and let us know if you have any questions or concerns.
FEES AND COSTS
Following confirmation of attendance, the Participant will be issued a payment invoice by the Organizers.
The invoice must be paid in full within seven (7) business days of receipt of invoice in order for the Participant’s place to be guaranteed.
Invoices will be issued by Isamiddinova und Marouche GbR with the address: Schwartzstr. 7, 13409 Berlin, Germany.
Included in cost. Accommodation; daily breakfast, lunch and dinner; workshops and group activities; in-country transportation; entry and access fees to cultural events or institutions as part of the itinerary; other activities and events which may be planned at the Organizer’s discretion;
Not included in cost. Airfare, passport, visa and permit expenses; travel insurance; medical expenses and immunizations; personal expenses such as additional food and beverage (alcoholic or otherwise), taxis or other personal transportation, laundry, telephone calls, SIM cards, additional activities and events and any other items not specifically noted as included.
PARTICIPANT CANCELLATIONS AND REFUNDS
The Participant retains the right to cancel the Contract at any time.
The Organizers’ general cancellation policy is as follows:
– 50% refund for Participant cancellations up to 30 days before start date.
– 25% refund for Participant cancellations up to 22 days before start date.
– No refund for Participant cancellations 0-21 days before start date.
ORGANIZERS CANCELLATIONS AND REFUNDS
The Organizers retain the right to cancel the Contract in the following events.
A minimum number of Participants is necessary to ensure the Experience is viable for the Organizers. The Organizers will notify the Participant of a cancellation due to insufficient participation no later than 21 days in advance. In the event that this occurs, the Participant will be refunded the full amount of the booking.
In the event that the Experience cannot take place due to statutory regulations, as well as general safety and travel concerns of the Organizers, the Participant will be refunded the full amount of the booking.
The Organizers do not accept liability for any incidental expenses that may incur as a result of a cancellation or for any other loss or damage howsoever caused by the cancellation.
INSURANCE
The Participant is responsible for obtaining travel insurance with adequate insurance cover for their stay and any activities which they intend to undertake during the period of travel.
The Organizers are not responsible for any robbery, theft or damages of personal items that occurs during the Experience.
PROFICIENCY IN ENGLISH
The Experience and all related activities will be conducted in English. The Participant is expected to have English proficiency in reading, writing and speaking.
CONFIDENTIALITY AND DATA USE
Information provided to the Organizers by the Participant has specific purposes and remains strictly confidential. The billing information will be used for invoicing. The Participant's email, phone number and social media details are used to communicate directly, to introduce the Participant to people in the Experience and to keep the Participant informed about activities.
RESPECTFUL BEHAVIOUR
The Experience is an intercultural, interpersonal journey. The comfort and well-being of each Participant is our priority. We expect the Participant to be respectful and considerate of everyone, including fellow Participants and staff. The Organizers reserve the right to deny any Participant further participation in the program if the Organizers deem it necessary for the comfort or safety of other Participants. In the event that the Participant is asked to leave, there will be no refund. Should the Participant decide, for whatever reason, to leave early, there will also be no refund and the Participant will be responsible for any associated costs.
DOCUMENTATION/VISA/ENTRY REQUIREMENTS
The Participant is responsible for obtaining any documents required for their participation in the Experience, such as a valid passport, visas and any other documents in a timely manner. Failure to obtain documents does not negate the Terms and Conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the Participant’s responsibility.
DISCLAIMER
The Organizers are not liable for, and the Participant waives any claim for: (A) any damage to, or loss of, property or injury to, or death of, persons suffered during the Experience, whether or not occasioned directly or indirectly by an act or omission of the Organizers or any other provider, including but not limited to any latent or undisclosed defect in any aircraft, watercraft, vehicle, hotel, apartment, workspace or other service or property operated or provided by the Experience or any other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the Experience or the other providers, or any negligent or willful act or failure to act of the Experience or any other provider or of any other third party, or any laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by Acts of God, strikes, fire, flood, war, rebellion, conflict & unrest, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against the Organizers for any such loss, damage, injury, or death and assume the risk of the Organizers’ negligence.
LIMITATION OF LIABILITY
To the fullest extent allowed by applicable law, under no circumstances and under no legal theory (including, without limitation, tort, contract, strict liability, or otherwise) shall the Organizers be liable to you, your employer, your client(s) or potential client(s), your guests/visitors, or to any other person for (A) any indirect, special, incidental, or consequential damages of any kind, including damages for lost profits, loss of goodwill, work stoppage or delays, regardless of whether the Experience has been advised of the possibility of such damages, or (B) any change in your employment status as a result of participating, or (C) any amount, in the aggregate, in excess of the amounts paid by you to the Organizers in connection with the program or the services in the twelve (12) month period preceding the applicable claim, or (D) any matter beyond our reasonable control. In connection with your participation, the Organizers shall not be liable to you for damages for emotional distress, mental suffering or psychological injury of any kind, under any circumstances.
